Content: The text, photos, images and graphics that
describe the Client's products and/ or services.
Content Management System (CMS): Alteration/ adjustment of content
within any page of the website.
Font: Any style of lettering used for the purpose of
logo design, and used in the content body of the website.
FTP: File Transfer Protocol: A system whereby files
are transfered to the server.
Hosting/ Webhost: The server on which your website
resides, and which makes your site available on the Internet.
ISP: Internet Service Provider
Logo: Any graphical image designed specifically for
the purpose of business recognition. The logo can consist of a unique,
customised font style, with or without support and integration of a
graphical device representing the business aspiration.
Site Management: Management of the functioning and
availability of the Client's website.
Template: The structure of the website that is consistent
on every page, including the logo/ banner, graphics, and navigation
menu.
The Client - In every case, the Client agrees to be bound by Our terms
of business. The general terms are set out on this page, but specific
terms relating directly to your project are issued with your Project
Proposal.
Liabilities - While Chromaforge will deliver your project
as agreed on a reasonable endeavours basis, We are not liable for any
losses incurred to You or Your business as a result of any matter arising
during or subsequent to the delivery of Your project.
Furthermore, Chromaforge is not liable or responsible for;
1. Content or representation of facts or other data contained within
the Client's website.
2. Any content subsequently added by the Client.
3. Any actual or perceived non-performance of the Client's website in
generating anticipated business.
4. Loss to your business due to failure or delays anywhere in the internet chain,
or for any other technical reason (such as interruption to email availablilty or website accessibilty)
that is beyond Chromaforge's control.
Special Offers - Any discounted offer applies for a
limited period only as specified in the advert, and the campaign reference
must be quoted at the time of Your enquiry.
Pricing, Payments and Refunds -
Pricing - Prices subject to change without prior notice. The Client
pays no VAT as Chromaforge is not currently VAT registered.
Payments - We only accept payments by direct bank transfer, however
for Clients who wish to pay by credit or debit cards, we will send you
a Paypal link (you don't need a Paypal account to make such a payment),
but will be subject to a 5% handing fee.
Deposits Policy - A deposit is required prior to commencement of any
project to the value of at least 25% of the effort content, PLUS the
full cost of domain purchase, website hosting and any software licence
(such as CMS or e-commerce) required as part of the project. Deposits
are strictly non refundable.
Invoice Terms - Invoices are payable by the Client within 14 days of
issue.
Sales Commission - We will pay commission to anyone
who refers business to us at the rate of 10% on each confirmed order,
up to a limit of £100.
Commission is paid only on the first order per 3rd party Client, and
excludes the value of domain purchase, site hosting and any software
licenses.
The Referee is required to confirm who they have refered to us, and
the 3rd party client is requried to confirm who refered them to us.
Commission fees will only be paid by Internet Banking directly to the
referee's bank account. Chromaforge does not issue cash or cheques.
Content Management -
We offer our Clients a content management page
editor using a web based 3rd party system. This is offered as an optional extra.
We can also manage your content on your behalf as and when required up to 1 hour per month
free of charge. This service is offered on that basis that you sign up for hosting with ChromaForge.
Should you already have you own WebHost, this service is not applicable
to you.
Included - Regular updates or modification of any text or dates, font
types or styles. Inclusion, swapping or deleting any graphics or photographs
within the content body. Changes to any hyperlinks within the content
body.
Excluded - Redesign of or relocation of any graphic or logo within the
webpage template, alterations to the template, request for inclusion
of any additional script within the code, or addition of new web pages.
Limitations - Updates done as soon as practicable at the client's request.
A minimum of 24hours notice is required - Chromaforge is not liable
should alterations be required at very short notice, although all requests
will be undertaken as soon as practicable. The client is liable for
supply of the required content, and for the representation of message
contained within.
The client is liable for copyright issues pertaining to any textual
content or photographs supplied for inclusion on their website.
Limits of Service - The above will be undertaken free of charge up to
the limit of 1 hour per month. Beyond this, an hourly rate of £25 per
hour will be chargeable.
Email - Free email is offered on that basis that you
sign up for hosting with ChromaForge as the hosting supplier we use
provides this facility. Should you already have you own WebHost, this
service is not applicable to you.
The email address will align with your domain name (ie someone@yourbusiness.com),
and is provided as a 'catch all' meaning that you can have multiple
addresses 'anything'@yourbusiness.com.
Hosting & Domain Names - All Clients are encouraged
to have their websites hosted by Chromaforge which is an additional,
chargeable item. However, if Clients wish to use their own hosting service,
Chromaforge will upload your website onto that webhost provided that
Clients make available all required password, login, folder structure
details and port numbers. Chromaforge will not be responsible for the
functionality of the Client's webhost, and Clients will not be eligible
for ongoing support, content or site management.
Domain Names - The cost of all domain suffixes (.co.uk,
.com, .net etc) are an additional chargeable item. We will help you
choose a domain name exactly or as near to the name you want ( ie www.yourbusiness.com)
but the availability of your chosen name is outside the control of Chromaforge.
Site Management - Assumptions - This service is offered
on that basis that you sign up for hosting with ChromaForge. Should
you already have you own WebHost, this service is not applicable to
you.
Included - Chromaforge will make all reasonable attempts to liaise with
the supplier in order to correct any technical issues highlighted by
the Client, usually within 24 hours.
Excluded - Chromaforge has no system in place to offer active monitoring
of the Client's website, therefore, it is the Client's responsibility
to notify Chromaforge of service related issues with their website.
Printing Press -
All artwork prepared for printing press is subject to particular
terms:
The Client can supply their own content for Chromaforge to base the
design upon, or we can create the content based upon your business requirement.
Each order is subject to individual quotation due to the number of possible
parameters in each project.
Any images supplied must be of at least 1MB in size to guarantee print
reproduction quality.
Proofs will be regularly supplied to the Client, and approval of the
final proof is required in writing (by email) prior to going to print.
Ownership and Copyright: Chromaforge will retain
the original layered files of all graphics and/ or webpages created
for the purpose of any potential ongoing or future business with the
Client.
The Client owns the copyright for all webpages (including content contained
within) created by Chromaforge.
Personal Data: Any personal data you submit for the
purpose of fulfilling your order will be never be shared with anyone
else unless it is required by law. For invoice requirements, you will
be asked to supply your name, postal address (and business name and
address if different), landline and mobile contact numbers.
Quality Management Statement:

Environmental Statement: The impact on the environment
is a core value for Chromaforge, where what is produced and how it's
produced is of great importance. All business activity is conducted
in a manner that respects and minimises use of power, materials and
waste, and environmental ethics are looked for in the type of resources,
suppliers or services used. This environmental ethic aligns with ISO
14001:2004.
